A. Background Why this assignment (rationale)?

Nepal Herbs and Herbal Products Association (NEHHPA) is an umbrella organization of the herbal producers, manufacturers, and traders in Nepal. It is established on 2002 to build up a sustainable business system of herbs and herbal sector in Nepal. The main goal of NEHHPA is to improve the livelihood and provide farmers with market access to create income opportunities for poor rural households and to provide necessary support to the rural community for producing and marketing quality products. NEHHPA has been focusing on many programs, events, and activities that are supportive to have extended marketing capabilities of its members as well as the entrepreneurs in this sector.

NEHHPA has financing agreement to carry out the activities of "Implementing the NTIS in the sector of Medicinal and Aromatic Plants (IN-MAPs)" Project, which is financed by the Deutsche Gesellschaft für Internationale Zusammenarbeit (GIZ) GmbH. The IN-MAPs project is being implemented in central level in Kathmandu and some activities in its prioritized districts i.e. Banke, Dang, Kailali, Kanchanpur, Pyuthan and Surkhet. The project aims to improve production, manufacturing and marketing practices of Medicinal and Aromatic Plants (MAPs) for their sustainability, strengthen the private sectors and facilitate the MAPs trade in Nepal.

Medicinal and aromatic plants (MAPs) are an important source of income in the Nepalese economy, which is exported worldwide. More than 300000 families are benefitted as an employee working full time and part-time. Nepal's export of MAPs contributes 5% to the national economy. In FY 2016/017, medicinal herbs of 4069720.7 Kg were exported valuing 733735000 NRs. (www.tepc.gov.np).

Training on market analysis is one of the key activities of NEHHPA. The training is based on the respective ITC online training package with regard to identifying proper export markets for MAPs products. After completing this training, trainees will be able to find the proper markets for their products using ITC Market Analysis Tool (MAT).

Identifying proper markets is the major challenge Nepalese exporters are facing today. There are numerous factors which are hindering a smooth flow of Nepal’s MAPs products to foreign market; exporters, as well as producers, should be well informed about the complexity of international trade with regard to custom and tax provisions, quality provisions, procedures, transport, payment systems and potential buyers, consumers’ behaviour, potential competitors etc. Before stepping into the export business, exporters should have a good knowledge of the above mentioned various aspects of Export Business.

NTFP/MAPs have a potential for contributing to the local economy and international revenue source. It has been evident that quality based products and effective marketing mechanism support to the growing business in MAPs sector which has been noticed in organic products marketing as a higher valued products in European and developed country markets. Realizing these facts, NEHHPA aims to capacitate its members in international marketing of NTFPs and MAPs through expert training. One of the major activity under /TPP programme is to promote marketing of the MAPs.

 

B. Details of Assignment – Terms of Reference (ToR)

1) Strategy: What is the objective? What results are needed to achieve the objective?

The main objective of this assignment is to capacitate NEHHPA members to conduct the Export Market Analysis (and aware them in international and national marketing opportunities, issues, trends, and scope) through the use of web tools. The assignment has involved technical experts and facilitators who act as resource persons for the expected outputs. NEHHPA in close coordination with GIZ/ (TPP), is on the verge of training its members. Following is the expected results of this assignment (contract):

The specific objectives of this training are as follows:

  • Design a comprehensive training course agenda (based on the existing training module) and contents for a 3 days training;
  • Train participants to use ITC’s online Market Access Tools, to identify and analyse MAPs products and target market for export;
  • Enhance capacity of participants to assess their export potential, and prepare a market profile for their product;
  • Assign at least two expert trainers for the training;
  • Prepare and provide the criteria for the participants;
  • Conduct pre and post-training evaluation with recommendations;
  • Submission of a Report on the training after completion of the assignment.

 

2) Cooperation: Who are the relevant stakeholders?

Specifically, NEHHPA members who are the active herbs and herbal products entrepreneurs are the key stakeholders for this training.

 

3) Process: Methodology to be used and different steps to be followed in order to achieve the results and objective defined in the strategy. What is the timeline?

Resource Person/Consultant in close consultation with NEHHPA and GIZ will design the all overall framework and develop training materials for the facilitation. S/he will assign the lead of overall assignment. The methodology and materials of training will be presented to and discussed with NEHHPA and INCLUDE/IN-MAPs team before actual implementation. The resource person/team of the consultant is expected to follow the following methodology:

  • Development of a training plan in consultation with the NEHHPA team.
  • Conduct meeting with NEHHPA and leading export companies to prepare for the training.
  • Share the agenda of the training program.
  • The training needs to be participant-focused. Consultants will use participatory approach during the training and also use participant friendly training materials, examples, and exercises
  • Prepare and submit the training course documents and process manual to NEHHPA for approval.
  • Organise the training and submit the final training completion report.
  • Imparting training on Market Analysis using the ITC Market Analysis Tools.

 

4) Steering: Who takes decisions and who must be informed about what and when?

For fulfilling this service, the resource person/consultant will closely work together with the NEHHPA and GIZ/TPP (IN-MAPs) team. NEHHPA in close coordination with GIZ/TPP (IN-MAPs) team will take the relevant decisions; steer the overall assignment and inform the consultant on due diligence process. Regular updates and interaction on the current status are expected.  

 

5) Learning and Innovation: What is the expected new knowledge to be created and in which form (e.g. publication)? How to transfer the knowledge to whom?

An in-depth knowledge on international marketing opportunities can be brought in action through proper implementation. The resource person/consultant shall first present the training module and material before actual implementation. Then resource person/consultant should facilitate the NEHHPA members aligning the reviewed training material. The training program through the verbal approach and prepared hand-outs shared will include different aspects of international marketing.

This training cum awareness, thus, will further strengthen international marketing awareness among NEHHPA members.

 

C. Key Requirement of Consultant(s) What qualification is required?

The resource person/consultant will have a responsibility of implementing training module and materials in consultation with NEHHPA team and GIZ/TPP (IN-MAPs) team. The resource person/consultant will be responsible for overall coordination and facilitation of the training with quality output. The consultant should have:

  • Well trained in ITC market analysis tools (Trade map, market access map, standards map, etc.) and a good grasp of export procedures of Nepal.
  • At least master degree in the fields like Informational technology with business administration or marketing or any relevant field.
  • Proven experience in providing training on conducting market analysis through the use of web tools and trade-related issues.
  • Sound knowledge on medicinal and aromatic plants (MAPs) sector
  • Very good knowledge on national and international marketing.
  • Excellent facilitation skills (training), writing and speaking skills in Nepali and English are expected.
  • CVs of the selected trainers should be submitted to NEHHPA for prior approval.

The objective of the trademark is to authenticate Nepal's Medicinal and Aromatic Plants (MAPs) products and enhance product recognition. As per the activity- Publish and Disseminate Trademark Guideline the trademark guideline needs to be designed and a layout to be prepared for the printing.

 

Tasks and responsibilities:

Under the direct supervision of the NEHHPA and GIZ, the firm has to design the trademark guideline and print it ensuring the consistency and continuity throughout the process.

 Specific duties include:

  1. Designing layouts of trademark guideline in consent with NEHHPA team and GIZ.
  2. Print 1000 copies of layout and submit to NEHHPA.

 

Requirements for firm

· Having a broad understanding of best practices in design, copy and print.

· An understanding of trademark development.

1. Terms of Reference (ToR) for Printing Press

Under the direct supervision of the NEHHPA team, the firm has to design the trademark guideline and print it ensuring the consistency and continuity throughout the process.

Specific duties include:

  • Designing layouts of trademark guideline in consent with NEHHPA team.
  • Print (Black & White) 1000 copies of the layout (which is 27 pages) and submit to NEHHPA.
  • The front page should be printed in color.

Requirements for firm

  • Having a broad understanding of best practices in design, copy and print.
  • An understanding of trademark development.
  • The firm should have tax clearance certificate.

  • Having a broad understanding of accounting systems for official work.
  • The firm should have tax clearance certificate.
  • Registered according to the rule of Government.

NEHHPA has developed the trademark “Nepal Herbs” for promotion, marketing and branding of the national herbs at international markets which is in process of registration. Thus, under the direct supervision of the NEHHPA team, the firm has to provide the consultant which duties are as followings;

  • Develop Trademark Monitoring Mechanism.
  • Submit it to NEHHPA in time for discussion.
  • Incorporate the comments and feedbacks and finalize it.

Requirements for consultant

  • He/She should be registered Lawyer of Nepal.
  • Should have sound knowledge on trademark development and monitoring mechanism.

With the aim of Nepalese MAPs export promotion in the foreign country, NEHHPA initiated to establish the collective trademark “Nepal Herbsas a brand for the Nepalese MAPs products. This collective trademark is created in 2015.The objective of the collective trademark is to authenticate Nepal's MAPs products, enhance product recognition and allows a Nepalese MAPs business to build public goodwill and brand reputation in the goods it sells. NEHHPA have finalized the collective trademark; logo “Nepal Herbs” and is initiating the registration process in Nepal and Internationally. Nepal is yet to implement the collective trademark 'Nepal herbs' for the sustainable promotion of this sector on which NEHHPA is taking lead. Moreover, there is a need to promote the collective trademark among the national exporter and convey them about the significance of developing the collective trademark. Along with this, information regarding the registration and documentation of collective trademark should be disseminated among the individuals and organizations being involved in the trade of MAPs.

As we know, MAPs sector is emerging as good economic source to the resource-poor and marginalized communities, by registering the collective trademark in different countries we can establish the market for our MAPs. The collective trademark not only increases the market in developed countries but also assures the faith for the quality and origin of the product. Realizing these facts, NEHHPA aims to disseminate information about collective trademark “Nepal Herbs” registration and documentation process within members. One of the major activity under TPP programme is to promote the trademark.

  • Develop a manual of documentation and registration process of the collective trademark by individual MAPs Company.

  • Enhance the knowledge of participants on documentation and registration process of the collective trademark.

  • Enhance the knowledge of participants on collective trademark as well as using applications;

  • Submission of a Report after completion of the assignment.

The participants are expected to aware about the registration and documentation process of collective trademark “Nepal Herb” and understand the value of collective trademark to establish Nepalese herbs and herbal products as a brand in foreign countries. Similarly, after the workshop, the wider announcement of a collective trademark through a mouth of words for its publicity is hoping to be done.  The proper implementation of the collective trademark will be brought into the action. The resource person/consultant shall first present the workshop plan and material before actual implementation. Then resource person/consultant should facilitate the NEHHPA members aligning the reviewed workshop material.

c)  Key Requirement of Consultant(s) What qualification is required?

The resource person/consultant will have a responsibility of implementing workshop module and materials in consultation with NEHHPA team and GIZ/TPP (IN-MAPs) team. The resource person/consultant will be responsible for overall coordination and facilitation of the workshop with quality output. The consultant should have:

  • Excellent facilitation skills writing and speaking skills in Nepali and English are expected.

  • CVs of the trainers should be submitted to NEHHPA for prior approval.

  • At least five years of work experience in the relevant field i.e collective trademark registration.

  • Sound facilitation and knowledge transfer skill.

  • At least bachelor’s degree in marketing, law and management, master’s degree in marketing is preferable. Knowledge on MAPs sector would be added value.
