    Call for Expression of Interest from Services Provider

    Nepal Herbs and Herbal Products Association (NEHHPA)   is an umbrella organization of Nepali herbal collectors, producers, manufacturers and traders in the sector of Non-Timber Forest Products (NTFPs), particularly Medicinal and Aromatic Plants (MAPs). NEHHPA has financing agreement with Deutsche Gesellschaft für Internationale Zusammenarbeit (GIZ) GmbH to carry out the activities of "Implementing the NTIS in the sector of Medicinal and Aromatic Plants (IN-MAPS)" Project which is financed by the Enhanced Integrated Framework with additional financial   support   from   the   German   Federal   Ministry   for   Economic   Cooperation   and Development (BMZ) and the Government of Nepal. The Project is executed by the Ministry of Forests  and  Soil  Conservation  (MoFSC)  with  technical  support  by  the  (GIZ).     The identified activities of IN-MAPs project is to:

    1. Registration of Collective trademark in Nepal
    2. Prepare NEHHPA MAPs traders Directory

    NEHHPA therefore seek new and existing service provider to work with us for this task. Interested service providers are requested to submit technical as well as financial proposal for this purpose. 

    Please include the following mandatory documents along with the proposal:

    1.   Organizational/Individual profile including:

    a.   Description of the organization/individual

    b.   Copy of Certificate of Company and VAT Registration

    c.   Specific services and expertise offered in major areas of EOI

    1. Title of Assignment: Registration of Collective trademark in Nepal.

    A. Background

    MAPs are exported worldwide and are an important source of income for Nepalese economy. These plants have a potential for contributing to the local economy and subsistence needs. Recent data[1] shows that in some rural hilly and mountainous areas, more than 50% of the population are engaged in MAPs trade and it contributes 10-100% income of rural communities. About 2, 50,000 people engaged in different activities along the ‘value chain of MAPs’.

    The value added products such as organic products have a higher price in European and developed country markets. But international market demands quality and standard product.Quality and standard products comes with trademark and branding. Although Nepal has been exporting MAPs internationally but there is no trademark to distinguish the Nepalese products. Inconsistency of MAPs sector is not only affecting the international business but quality dilemma about Nepal MAPs is a major concern for international buyer. So, to address the issue a 'Nepal Herbs' Collective Trademark was prepared in collaboration between NEHHPA, Jadibuti Association of Nepal (JABAN) and Herbal Entrepreneur Association of Nepal (HEAN) with support of Nepal German Trade Promotion Programme (TPP/GIZ) on 2015.

    The collective trademarks help to maintain common standards of Nepali herbal products while marketing these products in national and international markets. The collective logo was prepared after wider discussion and several revisions with interaction between major stakeholders including JABAN and HEAN along with concerned stakeholders including Department of Forest (DoF), Trade and Export Promotion Centre (TEPC), Department of Plant Resource (DPR) and Department of Industry (DoI).

    Collective registered trademark used by NEHHPA, JABAN and HEAN members companies will help them identify themselves with a level of quality or accuracy, geographical origin, or other characteristics set by the association. MAPs association company members are mainly small and Medium Enterprises (SMEs) therefore; this registered collective trademark will jointly market the products of a group of NEHHPA, JABAN and HEAN company members and enhance product recognition. Collective marks may be used together with the individual trademark of the producer of a given good. This allows companies to differentiate their own products from those of competitors, while at the same time benefiting from the confidence of the consumers in products or services offered under the collective mark.

    Although, the collective trademark “Nepal Herbs” was made but legal registration in government is yet to be done. According to government of Nepal the trademark has to be legally registered in the DoI. Only after registration the members companies of all the association will be able to use the trademark. Consequently, the stakeholders involved in preparing the trademark authorised NEHHPA to lead the registration process.

    In Nepal, Trademark can be protected on the basis of its registration; no one can claim trademark right on the basis of use within its territory. Full trademark protection is properly secured only by registration. Trade mark registration of “Nepal Herbs” protects the brands and also prevents others from using the same brand.

     

    B. Purpose of the assignment:

    The purpose of the assignment is to formally register the collective trademark   in “Nepal Herbs” in department of industry of Nepal by handling all the legal complications involved in the registration process of MAPs.

    The major objective of this activity is to authenticate the Nepal MAPs product in international market. Nepal herbal sector will be able to secure the following specific objectives:

    • Nepalese herbal trade mark will be able to communicate to the international market,
    • Tracing of Nepalese herbal by international clients will be made easy,
    • Nepal herbal sector will be able to effectively utilise the internet and social media
    • Create a platform for increasing the bargaining power of Nepalese herbal products

     

    C. Scope of service of the consultants:

    The scope of this assignment is as follows:

    • Development of registration process in consultation with DOI and NEHHPA
    • Identification of legal procedure to register the collective trade mark
    • Identification and Compilation of the documents in collaboration with NEHHPA team
    • Providing relevance  of legal aspects during the registration process to NEHHPA, HEAN and JABAN team
    • Registration for each category has to be defined and conducted
    • Product characteristics wise trademark to be suggested.
    • For fulfilling this service, the resource person/consultant will closely work together with the NEHHPA specially IN-MAPS project Coordination and NEHHPA executives. NEHHPA in close coordination with GIZ/INCLUDE (IN-MAPS) team will take the relevant decisions; steer the overall assignment and inform the consultant on due diligence process. Regular updates and interaction on the current status is expected.
    • All information collected during this study is to be treated strictly confidential.
    • Discussions/meetings with the government line agencies i.e. Department of industry, specifically, government line agency related to Department of Industry are the relevant stakeholders to be visited for this purpose.
    • Nepal Herbs trademark has to be legally registered under the government of Nepal. All the three associations of herbal products NEHHPA, HEAN and JABAN will exercise the benefit of the Trademark. 

     

    D. Approach/Methodology:

    The methodology and tools will be presented to NEHHPA before actual implementation. Resource Person/Consultant in close consultation with NEHHPA and GIZ will design the all overall framework. S/he will lead the overall assignment. The methodology will be presented to and discussed with NEHHPA and INCLUDE/IN-MAPs team before actual implementation. The resource person/team of consultant is expected to follow the following methodology:

    • The consultant  shall collect the required documents from NEHHPA
    • The consultant shall work with NEHHPA programme coordinator and executives to finalise the work plan. The consultant shall fulfil the necessary procedural and formal requirements.
    • The consultant shall submit the application on behalf of NEHHPA to DoI.
    • The consultant shall present a work plan with timeframe for registration process.
    • Follow up to trademark departments for lobbing and all mandatory works.
    • Prepare and publish the newspaper notice as per the demand of trademark registration process
    • Registration for each category has to be defined and conducted
    • Product characteristics wise trademark to be suggested.
    • Perform all the relevant task in relation to the entire registration process
    • Submit the final legal documents/trademarks registration certificate to NEHHPA

     

    E. Key requirements of consultant/consultancy institution:

    The resource person/consultant will have a responsibility of designing framework for registration process in consultation with NEHHPA team. The resource person/consultant will be responsible for overall coordination and facilitation of the process. The consultant should have:

    • University Degree in law and have a relevant working experience in the sector 
    • Experience in trademark registration in Nepal sector
    • Very good knowledge on theoretical and practical aspects of trade mark and branding.
    • Sound knowledge on medicinal and aromatic plants (MAPs)
    • Experience in approaching, coordinating and familiarizing with concerned stakeholders is expected.
    • Additional degree and experiences  in  Agriculture, Botany, Forestry, natural resource management  will be an added advantages 
    • Proficient in both English and Nepali

     

    F. Expected Results/ Outputs:

    2. Title of Assignment: NEHHPA MAPs traders Directory.

    A. Background

    Nepal Herbs and Herbal Products Association (NEHHPA), an umbrella organization of Nepalese herbal producers, manufacturers and traders in the Non-Timber Forest Products (NTFPs) sector particularly covering Medicinal and Aromatic Plants (MAPs) sub-sector, was established in 2002. NEHHPA is working to build sustainable business system for the promotion of herbs and herbal sector in Nepal.

    NEHHPA vision is “Sustainable, profitable and healthy commercialization of herbs and herbal products in Nepal contributing towards the overall economic development of the nation”.

    Mission of NEHHPA is to:

    • To understand and respond to members’ business development needs and aspirations and create enabling environment.
    • To provide business services in terms of knowledge, information, skills, advocacy and business development services to the stakeholders.
    • To attract, serve and mobilize new members by providing affordable, accessible and applicable business service.
    • To work closely and collaboratively with members and stakeholders to promote profitable MAP business enterprises.

    NEHHPA’S activities includes:

    NEHHPA actively supports its member companies through:

    • Human and Institutional Development (HID) through Training and Capacity building
    • Enhance individual, technical and systemic capacity of staff, producers and entrepreneurs to produce, process, supply and market quality goods and products
    • Data, Information for Market Information System (MIS) Development and Networking
    • Build data and knowledge base to increase marketing capacity for growth and development of MAP products in local and international market through development of proper markets and marketing channels.

    • Create favorable working condition and supportive regulatory mechanisms for MAPs/NTFPs business and enterprise development and operation.

    NEHHPA members includes Herbal collectors and producers, Manufactures and Traders. NEHHPA stands as leading business promotion organization in NTFPs/MAPs sub-sector partnering with national and international organizations. Currently NEHHPA members consists of seventy nine members.  As a part of strategic activity of  building data and knowledge base to increase marketing capacity for growth and development of MAP products in local and international market through development of proper markets and marketing channels as well as  improving the networking among the NEHHPA members company NEHHPA is planning to create a NEHHPA MAPs traders directory. This directory will be a strong tools for its members company to communicate with the buyers as well as among themselves. NEHHPA members are spread all over Nepal.  So, this data base increase the access to members companies.

    NEHHPA members always search for activities from NEHHPA to increase their market linkage and networking. So, creating a NEHHPA MAPs traders directory will help build the capacity of NEHHPA members.

    B. Purpose of the assignment:

    The purpose of the conducting this assignment is to create a NEHHPA members company MAPs traders directory.

    NEHHPA MAPs trader’s directory has to provide information about following components but not limited to:

    • Name of the company,
    • Owner’s name,
    • Established date,
    • Address,
    • Contact number,
    • Email address,
    • Website address
    • Major partners/Allies (if any),
    • Organizational objective,
    • Nature of business,
    • Exports items and
    • Products of the organization.

    C. Scope of service of the consultants:

    The scope of this assignment is as follows:

    • The methodology and tools will be presented to NEHHPA before actual implementation.
    • Resource Person/Consultant in close consultation with NEHHPA will design the all overall framework.

    • Make a checklist of all the components for which the information is required
    • Verify the checklist with NEHHPA team
    • The consultant  shall collect the required documents from NEHHPA
    • Contact with NEHHPA members for acquiring the desired information
    • Compilation of all the collected information in standard format

    E. Key requirements of consultant/consultancy institution:

    The resource person/consultant will have a responsibility of designing the in consultation with NEHHPA team. The resource person/consultant will be responsible for overall coordination and facilitation of the process. The consultant should have:

    • At least Master’s Degree in management
    • Experience in similar field
    • Knowledge in research and data collection
    • Proficient in both English and Nepali
