    Background Why this assignment (rationale)?

    Nepal Herbs and Herbal Products Association (NEHHPA) is an umbrella organization of the herbal producers, manufacturers and traders in Nepal. It is established on 2002 to build up sustainable business system of herbs and herbal sector in Nepal. The main goal of NEHHPA is to improve the livelihood and provide farmers with market access to create income opportunities for poor rural households, and to provide necessary support to the rural community for producing and marketing quality products. NEHHPA has been focusing on many programs, events and activities that are supportive to have extended marketing capabilities of its members as well as the entrepreneurs in this sector.

     

    NEHHPA has financing agreement to carry out the activities of "Implementing the NTIS in the sector of Medicinal and Aromatic Plants (IN-MAPs)" Project which is financed by the Deutsche Gesellschaft für Internationale Zusammenarbeit (GIZ) GmbH. The IN-MAPs project is being implementing in central level in Kathmandu and major activities in its prioritized districts i.e. Banke, Dang, Kailali, Kanchanpur, Pyuthan and Surkhet. The project aims to improve production, processing and marketing practices of Medicinal and Aromatic Plants (MAPs) for their sustainability, strengthen the private sectors and facilitate the MAPs trade in Nepal.

    With the aim of Nepalese MAPs export promotion in foreign country, NEHHPA initiated to establish the collective trademark “Nepal Herbsas a brand for the Nepalese MAPs products. This collective trademark is created in 2015.The objective of the collective trademark is to authenticate Nepal's MAPs products, enhance product recognition and allows a Nepalese MAPs business to build public goodwill and brand reputation in the goods it sells. NEHHPA have finalized the collective trademark; logo “Nepal Herbs” and is initiating the registration process in Nepal and Internationally. Nepal is yet to implement the collective trademark 'Nepal herbs' for the sustainable promotion of this sector on which NEHHPA is taking lead. Moreover, there is a need to promote the collective trademark among the national exporter and convey them about the significance of developing the collective trademark. Along with this, information regarding the registration and documentation of collective trademark should be disseminated among the individuals and organizations being involved in the trade of MAPs.

     

     

     

    As we know, MAPs sector is emerging as good economic source to the resource poor and marginalized communities, by registering the collective trademark in different countries we can establish the market for our MAPs. The collective trademark not only increases the market in developed countries but also assures the faith for the quality and origin of the product. Realizing these facts, NEHHPA aims to disseminate information about collective trademark “Nepal Herbs” registration and documentation process within members. One of the major activity under TPP programme is to promote the trademark.

     

    Terms of Reference (ToR)

    Strategy: What is the objective? What results are needed to achieve the objective?

     

    The main objective of this assignment is to disseminate the information regarding the registration and documentation process of the collective trademark “Nepal Herbs”.

    The specific objectives of this workshop are as follows:

    • Develop a presentation on documentation and registration process of collective trademark by individual MAPs Company.
    • Enhance the knowledge of participants on documentation and registration process of collective trademark.
    • Enhance the knowledge of participants on collective trademark as well as using applications;
    • Submission of a Report after completion of assignment.

     

    Cooperation: Who are the relevant stakeholders?

     

    Specifically, NEHHPA members as well as member from JABAN and HEAN, who are the active herbs and herbal products entrepreneurs, are the key stakeholders for this workshop.

     

    Process: Methodology to be used and different steps to be followed in order to achieve the results and objective defined in the strategy. What is the timeline?

     

    Resource Person/Consultant in close consultation with NEHHPA and GIZ will design the all overall framework and develop workshop materials for the facilitation. S/he will assign the lead of overall assignment. The methodology and materials of workshop will be presented to and discussed with NEHHPA and TPP/IN-MAPs team before actual implementation. The resource person/team of consultant is expected to follow the following methodology:

     

    • Development of a workshop plan in consultation with the NEHHPA team.
    • Conduct meeting with NEHHPA, JABAN and HEAN and GIZ to prepare for the workshop.
    • Share the agenda of workshop program.
    • The workshop needs to be participant focused.
    • Prepare and submit the workshop course documents and process manual to NEHHPA for approval.
    • Organise the workshop and submit the final workshop completion report.

     

    Steering: Who takes decisions and who must be informed about what and when?

     

    For fulfilling this service, the resource person/consultant will closely work together with the NEHHPA and GIZ/TPP (IN-MAPs) team. NEHHPA in close coordination with GIZ/TPP (IN-MAPs) team will take the relevant decisions; steer the overall assignment and inform the consultant on due diligence process. Regular updates and interaction on the current status is expected.  

     

    Learning and Innovation: What is the expected new knowledge to be created and in which form (e.g. publication)? How to transfer the knowledge to whom?

     

    The workshop will circulate information on developed collective trademark as well as registration and documentation process. The participants are expected to aware about the registration and documentation process of collective trademark “Nepal Herb” and understand the value of collective trademark to establish Nepalese herbs and herbal products as a brand in foreign countries. Similarly, after the workshop wider announcement of collective trademark through mouth of words for its publicity is hoping to be done.  The proper implementation of the collective trademark will be brought into the action. The resource person/consultant shall first present the workshop plan and material before actual implementation. Then resource person/consultant should facilitate the NEHHPA members aligning the reviewed workshop material.

     

    Key Requirement of Consultant(s) What qualification is required?

     

    The resource person/consultant will have a responsibility of implementing workshop module and materials in consultation with NEHHPA team and GIZ/TPP (IN-MAPs) team. The resource person/consultant will be responsible for overall coordination and facilitation of the workshop with quality output. The consultant should have:

     

    • Excellent facilitation skills writing and speaking skills in Nepali and English are expected.
    • At least five years of work experience in the relevant field i.e. collective trade mark registration.
    • Sound facilitation and knowledge transfer skill.
    • At least bachelor’s degree in marketing, law and management, master’s degree in marketing is preferable. Knowledge on MAPs sector would be added value.
